This policy sets out what you must not do while using our services. It forms part of the Terms of Service, and breaking it is a breach of contract.
It applies to your account, to domains you register or manage through us, to nameserver settings, and to any other service we provide.
1. Prohibited in every case
Whatever the domain or service is used for, you must not use our services for:
- Unlawful activity: anything contrary to the laws of Hong Kong or any other applicable jurisdiction, including fraud and dishonesty under the Crimes Ordinance (Cap. 200), money laundering offences under the Organized and Serious Crimes Ordinance (Cap. 455), offences under the Dangerous Drugs Ordinance (Cap. 134), unlawful gambling under the Gambling Ordinance (Cap. 148), terrorism under the United Nations (Anti-Terrorism Measures) Ordinance (Cap. 575), and any sanctions or export control measure.
- Infringement of intellectual property: infringing another's copyright, trade mark, patent or other rights (Copyright Ordinance Cap. 528, Trade Marks Ordinance Cap. 559, Patents Ordinance Cap. 514).
- Spam and unsolicited commercial messages: sending commercial electronic messages in breach of the Unsolicited Electronic Messages Ordinance (Cap. 593); harvesting, buying or selling email addresses; phishing; impersonating a sender.
- Malicious technical activity: distributing viruses, trojans, ransomware or other malicious code; building or running botnets; denial of service attacks; port scanning; vulnerability probing; unauthorised access to systems or data.
- Impersonation and deception: impersonating a person, organisation or member of our staff; forging sender information; deceptive marketing.
- Abuse of persons: defamation, harassment, threats, hateful or discriminatory content.
- Child sexual exploitation, human trafficking, or any other serious abuse of human rights.
2. Domain-related abuse
- Cybersquatting, typosquatting, or registering another's trade mark or name in order to extract payment.
- Giving false, forged or third-party identity details in registration data, or supplying forged verification material.
- Using large numbers of domains for spam, phishing, or evasion techniques such as fast flux.
- Abusing our transfer processes, or bringing a domain dispute without any legitimate right.
3. What we do when we find a breach
- We assess the report. Where the problem is minor we may first ask you to fix it within a reasonable period.
- Where the matter is serious or urgent - fraud, malware, child safety, an attack in progress - we may suspend the service or domain immediately and without prior notice.
- We may report the matter to the registrar, the registry, ICANN, the Hong Kong Domain Name Registration Company Limited (HKDNR, for .hk domains) or law enforcement such as the Hong Kong Police.
- Suspension or termination for a breach is not refundable, and a reasonable handling charge may apply.
- You may appeal after receiving notice; we will review the decision and explain the outcome.
4. Reporting abuse
If you believe a domain or service we manage is being used for something this policy forbids, write to hp@ry.hk or use the channels in the Abuse and Copyright Policy, giving as much of the following as you can:
- the domain or service address concerned;
- what the abuse is, when it happened, and the evidence (logs, screenshots, full email headers);
- your relationship to the matter (rights holder, affected party, or agent);
- your contact details, and whether you consent to us passing your report to the other side.
We normally acknowledge within 3 working days and give a preliminary view within 10 working days.
